Business Improvement and Growth (BIG) Grant Program

1. What improvements are eligible for the BIG grant program?: - Restoration of exterior details in historically contributing or significant buildings, and removal of elements that conceal architectural details, including cleaning, repainting or residing of building
- New storefront construction, appropriately scaled within an existing building, that is in substantial conformance with all applicable provisions of the San Marcos Land Development Code
- Awnings or canopies in character with the building and streetscape
- Lighting that is visually appealing and appropriately illuminates signage, storefront window displays, and recessed areas of a building façade
- Window replacement and window framing visible from the street and appropriately scaled to the building
- Signage that is attractively integrated into the architecture of the building, including the window area, awnings or canopies, and entryways, and the removal and replacement of non-conforming signs
- Installation of monument signage, and the removal and replacement of non-conforming signs
- Curbing, irrigation, approved trees, landscaping beds (not including planting material) or other landscape features attached to the building where appropriate, not to exceed 20% of the project budget
- Removal of architectural barriers to public accessibility
- Installation of fire sprinklers or other life-safety systems in historically or architecturally significant buildings
- Other improvements that meet the objectives of the BIG Grant Program

2. Who is eligible for the BIG grant program?: - Applicants must be commercial property owners or commercial tenants located in San Marcos within the Downtown SmartCode zoning district or along designated corridors
- Preference will be given to independent businesses not required by contractual arrangement to maintain standardized decor, architecture, signs or similar features
- Tenants must have written approval from property owners to participate in the program
- Any nonconforming signage on the property must be permanently removed as part of the improvement
- Property owners must be current on all municipal taxes prior to participation in the program
- Applicants must comply with all State and local laws and regulations pertaining to licensing, permits, building code and zoning requirements
- Applicants must agree not to change or alter the property improvements without prior written approval from the BIG Review Committee for 3 years from the date of the rebate check issued under the BIG Grant Program
- Improvements made prior to written approval by the BIG Review Committee will not be funded
- Understanding that the overall objective of the BIG Grant Program is to improve the exterior visibility and presentation of a property, the City has the discretion to decline an application while suggesting enhancements that would enable future acceptance

2022 July 4th Fireworks

1. What’s the City of San Marcos Code of Ordinances pertaining to fireworks?: “The sale, possession, storage, discharge, or offer for sale of fireworks” is declared a public nuisance according to Chapter 38 of the City of San Marcos Code of Ordinances Sec. 28.054. The owner, lessee or occupant of the property or structure where fireworks are being stored or used are deemed responsible for violations of the ordinance.

2. Are fireworks allowed in San Marcos?: It is illegal to sell, possess, store, discharge, or offer fireworks for sale within the city limits of San Marcos or within 5,000 feet of San Marcos city limits, including sparklers and noisemakers. There are no types of fireworks that can legally be used in San Marcos.

3. What is the penalty for using fireworks within San Marcos city limits, or within 5,000 feet of the city limits?: The ordinance is part of the fire safety code, which carries fines for violations of up to $2,000.

4. I've noticed someone illegally popping fireworks. Who do I call?: To report illegal use of fireworks, call the non-emergency line at 512-753-2108. Please only call 911 if it is a life-threatening emergency so that our dispatchers remain available to respond to other emergency calls.

5. Will there be a public firework display in San Marcos?: Yes! The City of San Marcos Parks and Recreation Department will host the 42nd annual SummerFest firework show on Monday, July 4. Fireworks will be launched from the Bobcat Stadium west parking lot, located behind HEB, beginning at 9:30 p.m. Patriotic music will simulcast on 89.9 KTSW radio station.

6. Where can I park and watch the public firework display?

The best places to park for the public firework display include:

• The San Marcos Activity Center, 501 E Hopkins St.

• The San Marcos Public Library, 625 E Hopkins St.

• San Marcos City Hall, 630 E Hopkins St.

• Bobcat Stadium, 1100 Aquarena Springs Dr.

7. I plan to watch the display from a city park. What are the rules?: Prohibited items in city parks include consumption and public display of alcohol, glass containers, Styrofoam containers, and smoking or e-cigarettes/inhaled vapor devices. Unless otherwise posted, park curfew is 11 p.m. to 6 a.m. Trash should be properly discarded. We recommend leaving pets safely at home during the firework display. 8. Will this year’s SummerFest event include the Children’s Patriotic Costume Contest?: This year’s Children’s Patriotic Costume Contest is being held virtually. Submissions were due via email by June 27. The deadline to enter the contest has passed, however voting will continue on the SMTX Community Services Facebook page through Tuesday, July 5 at 11:59 p.m. The winner will be announced Wednesday, July 6.

9. I live outside of San Marcos city limits. If I plan to set off fireworks, what rules should I follow?: Fireworks cannot be lit near schools, including colleges or universities, churches, hospitals, licensed childcare centers, gas stations, or near where fireworks are sold. Fireworks cannot be ignited or discharged in or from a motor vehicle or thrown toward a motor vehicle.

10. How does the Hays County burn ban impact the use of fireworks outside of San Marcos city limits?: Hays County is currently under a burn ban, which prohibits outdoor burning including brush burning, bonfires, and burning household debris. Because of the burn ban, the Hays County Commissioners Court voted to temporarily ban the sale of two types of fireworks: skyrockets with sticks and missiles with fins. This means that fireworks other than the restricted varieties can be sold and used in unincorporated areas of Hays County, even with the burn ban in effect.

11. I live outside of San Marcos city limits and plan to set off fireworks permitted for use. What safety tips should I follow?: Always follow the instructions listed with the firework and avoid shooting fireworks near dry grass, brush, or other materials that can easily catch fire. Keep fireworks out of the hands of children and never aim a firework where they could land on a house or hit a person. Have a bucket of water, a garden hose, or another water source accessible in case of an emergency. Always pick up and soak firework debris in water prior to disposal.

Backflow Prevention

1. What is a cross-connection?: A cross-connection is any temporary or permanent connection between a public water system or consumer's potable (e.g., drinking) water system and a source or system containing non-potable water or other substances. An example is the piping between a public water system or consumer's potable water system and an auxiliary water system, cooling system or irrigation system. 2. What is backflow?: Backflow is the reversal of flow of water or other substances through a cross-connection into the public water system or consumer's potable water system. There are 2 types of backflow... Backpressure backflow and back-siphonage. For more information please call 512-393-8008.

3. What is backpressure backflow?

Backpressure backflow is backflow caused by a downstream pressure that is greater than the upstream or supply pressure in a public water system or consumer's potable water system. Backpressure can result from an increase in downstream pressure, a reduction in the potable water supply pressure, or a combination of both.

Causes of increases in downstream pressure:

- Pumps (such as wells and booster pumps)

- Temperature increases in boilers, etc.

Causes of decreases in downstream pressure:

- Breaks in water mains

- Fire fighting

- Water line flushing

4. What is back-siphonage?: Back-siphonage is backflow caused by a negative pressure (e.g., a vacuum or partial vacuum) in a Public water system or consumer's potable water system. The effect is similar to drinking water through a straw. Back-siphonage can occur when there is a stoppage of water supply due to a nearby fire fighting, a break in a water main, etc. For more information please call 512-393-8008.

5. Why does the Water / Wastewater Utilities Department need to control cross-connections and protect its public water system against backflow?: Backflow into a public water system can pollute or contaminate the water in that system making it unsafe to drink. Each water supplier has a responsibility to provide water that is usable and safe to drink under all foreseeable circumstances. Furthermore, consumers have faith that water delivered to them through a public water system is safe to drink. Therefore, the Water/Wastewater Utilities Department must take precautions to protect its public water system against backflow. For more information please call 512-393-8008.

6. What should a water supplier do to control cross-connections and protect their public water systems against backflow?

The Texas Commission on Environmental Quality gives public water suppliers 2 options:

- Require backflow prevention at each service connection that may create a threat to the public water supply.

- Require backflow devices and assemblies within a premise as outlined the state required plumbing codes.

The water suppliers usually do not have the capability to repeatedly inspect every consumer's premises for cross-connections and backflow protection. Generally, this would include the water service connection to each dedicated fire protection system or irrigation piping system and the water service connection to each of the following types of premises:

(1) Premises with an auxiliary or reclaimed water system

(2) Industrial, medical, laboratory, marine or other facilities where objectionable substances are handled in a way that could cause pollution or contamination of the public water system

(3) Premises exempt from the State Plumbing Code inspection and premises where an internal backflow preventer required under the State Plumbing Code is not properly installed or maintained

(4) Classified or restricted facilities

(5) Tall buildings

7. What is a backflow preventer?: A backflow preventer is a means or device which prevents pollutants and contaminants from flowing into the public water system. For more information please call 512-393-8008.

8. What is an air gap?: An air gap is a vertical, physical separation between the end of a water supply outlet and the flood-level rim of a receiving vessel. Find more information regarding air gaps.

9. What is a reduced pressure zone assembly?: A reduced pressure zone assembly protects water from substances that may contaminate water causing illness or death. Find more information regarding pressure zones.

10. What is a double-check valve assembly?: A double-check valve assembly protects water from substances that may pollute but not contaminate the water. Find more information about double-check valves.

11. What is a hose bibb vacuum breaker?: A hose bibb vacuum breaker (HBVB) is one of the least expensive and most commonly used backflow preventers. Find more information regarding bibb vacuum breakers.

13. Why do backflow preventers have to be tested periodically ?

In order to insure the proper operation of a backflow assembly, it must be tested and certified upon installation and periodically thereafter as required by state code. If the hazard (substance you are protecting against) is considered a high hazard (e.g., a hazard that can cause health problems), the City requires that the device be tested annually.

If the hazard is considered a low hazard (e.g., the hazard effects only the taste and odor of the water), the City requires testing every 3 years. The Texas Commission on Environmental Quality oversees the state requirements. For more information please call 512-393-8008.

14. Why does a soft drink dispensing machine require backflow protection?: Soft drink dispensers (post-mix carbonators) use carbonated water mixed under pressure with syrup and water to provide soft drinks beverages. Many, if not most water pipes are made of copper. When carbonated water comes into contact with copper, it chemically dissolves the copper from the pipe. This copper-carbonate solution has been proven to be a risk to the digestive system. For more information please call 512-393-8008.

4. Is there a limit of the number of birth certificates I can get at 1 time?: No, but there is a limit of 10 in your life time. Although you can get more than 1 at a time, you will need to list a different reason for each request.

3. Is there a difference in cost if you're a resident versus non-resident?: Yes.

4. Is there a calendar for day events, lunch, snacks, etc?: Yes, this can be found at each camp starting the first week of camp. You can also pick up a paper copy from your site.

5. Will lunch be provided?: Yes, breakfast and lunch will be provided by SMCISD.

Cape's Dam

1. Why is the City working with state and federal agencies to remove Cape’s Dam?: Cape’s Dam was severely damaged in three major floods in 2013 and 2015 and is now a hazard to river users. After numerous public discussions, studies, and input from both the U.S. Fish and Wildlife Service and the Texas Parks and Wildlife Department, the San Marcos City Council voted on March 15, 2016 to have the dam removed.

2. How long has the City been working on a plan to address the safety concerns at Cape’s Dam?: City boards and staff have been discussing options for the dam since 2014 when the Parks and Recreation Advisory Board requested a study be done on the environmental and recreational issues associated with the dam.

3. Where will the money to remove the dam come from?: U.S. Fish and Wildlife Service will remove the dam at no cost to the City.

4. What studies have been done to determine the effects of removing the dam?: A study was done to explore the effects of removing the dam on water level, river ecology, and future recreational use. Cape's Dam Study (PDF)

5. What about the historical significance of Cape’s Dam and the mill race?: The City of San Marcos values our rich history. The City has requested a consultation with the State Historical Preservation Officer from the Texas Historical Commission regarding removal of the dam.

6. Is removal of Cape’s Dam a component of the Edward Aquifer Habitat Conservation Plan?: No, this is a separate project. The Habitat Conservation Plan involves bank stabilization and riparian restoration upriver of Cape’s Dam. Removal of non-native littoral and aquatic vegetation and establishment of native vegetation is being undertaken in this reach of the river. Habitat Conservation Plan Website

7. What public discussions were held about the future of the dam?: There have been six Parks Board meetings regarding the dam - August 26, 2014; September 23, 2014; January 15, 2015; February 19, 2015; April16, 2015; July 16, 2015 and January 21, 2016.

In addition, the San Marcos City Council had a guided tour of the dam on August 31, 2015, a workshop on February 22, 2016; and voted March 15, 2016 to remove the dam.

8. Has the City allocated money to build a whitewater park similar to Rio Vista?: No.

CCN FAQ

1. What is a CCN?: A Certificate of Convenience and Necessity (CCN) is issued by the State of Texas Public Utility Agency (PUC) to allow orderly, efficient and cost effective extension of water and/or wastewater services to developing areas. The CCN grants exclusive retail service rights to the water and/or wastewater service provider (City of San Marcos).

2. Why has the City of San Marcos applied for expansion of their wastewater CCN area?: Multiple subdivisions and developers have requested extension of water and wastewater services to developing areas in the ETJ outside the existing CCN boundaries. The City has agreed to these requests and has applied to add those areas and adjacent areas to the CCN. Requests to amend the CCN are a normal step with development.

3. I received a notice but did not request utility service. Will CCN coverage, if granted, mean I have to connect to the wastewater system if it passes by?: No, properties in the ETJ will not be required to connect. If they desire central sewer service, they will be eligible to connect to the system.

4. Does this mean if the CCN is granted my property will be annexed into the City of San Marcos?: No, inclusion or exclusion of a given property in a CCN has no bearing on annexation.

5. If the CCN expansion is granted, does it tax or in any way cost me money?: No, this does not give taxing authority or require any payments. If a property chooses at some point to connect to City utility service, they would pay for service at that time as does any other utility customer.

6. Why did I get this notice, if I did not request service now?: The PUC rules require the City notify all affected county governments, water and wastewater retail providers, municipal utility districts, ground water districts and property owners in the areas proposed for coverage. The City has sent 3600 + letters to provide required notice, as well as, publishing the notice in four local newspapers.

7. Why are properties in between current CCN areas of the City and new subdivisions requesting service included in the request?: Pipelines would necessarily cross areas in between and it is best engineering and efficiency practice to serve those areas, if and when properties would choose to connect, such as when on-site septic systems need replacement.

8. If I object to inclusion of my property in the CCN area, what can I do?: Comments may be filed by all property owners with the PUC for their use in consideration of the application. Properties larger than 25 acres have specific rights to request “opt out” of the CCN areas by filing objections as specified in the notice

Cemetery FAQs

1. What are the cemetery hours?: The cemetery will be open daily for visiting, care of graves, and other appropriate uses from 8:00 a.m. to 6:00 p.m. during Central Standard Time, and from 8:00 a.m. to 7:00 p.m. during Central Daylight Savings Time. The gates are locked at closing time.

2. Are solar lights, spinners, swings, and/or wind chimes allowed?: These items are not allowed in the cemetery. No items are to be hung from trees.

3. How do I find out if there are available plots for sale?: Contact Jay Cody, Caretaker during regular business hours Monday through Friday 8:00 a.m. to 5:00 p.m. at 512-748-9671 to schedule a tour.

4. Who do I contact to make a payment on my plot?: Contact the Parks and Recreation Department to make a credit card payment by phone at 512-393-8400. You can mail a check to Parks and Recreation Department 630 E. Hopkins, San Marcos TX, 78666. Attention: Cemetery. Include your account number in the memo line.

5. Who do I contact for urgent matters, after hours (i.e. a pipe is broken, etc.)?: You may contact the San Marcos Police Department Non-emergency line at 512-753-2108.

6. Are glass vases allowed on a grave site?: No, glass vases are not allowed in the cemetery at all. Vases that are made of a compliant material and are attached to the base of the monument are allowed. Another option is an inverted vase that can be purchased from a local monument company, or a piece of PVC pipe that is flush with the ground to put artificial flowers in.

7. Are statues, figurines, and/or memorabilia allowed on a grave site?: These items are allowed as long as the items are on the monument and are not in the way of mowing and/or weed eating. The items are allowed for a period of two weeks. After that time or when they become a hazard to mowing they will be removed. If you want the items, please remove them before the two week period ends.

8. Are animal feeders or animal houses allowed?

Animals feeders or animal houses are not allowed. No items may be hung from any tree, shrub or plant.

9. What are the approved materials for monuments and benches?: Lots may have benches of marble, granite, concrete, or material approved by the cemetery commission. Any other structural amenities, which must also be primarily of marble or granite, must have the approval of the cemetery commission before being placed on the lot.

10. When and where are the Cemetery Commission Meetings?: The meetings are held on the 4th Wednesday of the month. See the posted Agenda for time and location.

11. When are the Cemetery Cleanups?: Please check the Cemetery home page for clean up dates. All items not in compliance with City cemetery regulations will be removed from the burial sites and held for families to pick up for 30 days at the cemetery maintenance shop. Prohibited items include glass containers, solar lights, spinners, swings and wind chimes.

12. Who do I contact to take a tour of the cemetery?: Contact the Caretaker during regular business hours. Monday through Friday 8:00 a.m. to 5:00 p.m. at 512-748-9671 to schedule a tour.

13. What time are the cemetery gates locked?: The cemetery will be open daily for visiting, care of graves and other appropriate uses from 8:00 a.m. to 6:00 p.m. during Central Standard Time, and from 8:00 a.m. to 7:00 p.m. during Central Daylight Savings Time. The gates are locked at closing time. If you are locked in call the San Marcos Police Department Non-emergency line at 512-753-2108.

14. What are the rules of the cemetery?: Rules and Regulations

15. Are grave liners required?: Yes. The mortuary performing interment services, for any casketed remains, must use a grave liner made of concrete, metal, poly, or other material approved under state law.

16. Can I water my plot(s)?: Yes. Water is for landscape irrigation use only. Watering is allowed only by hand-held hose or by sprinkler connected to a hose while the person that connected the sprinkler is present and only on the days and times designated in the approved irrigation conservation plan for the cemetery. No other temporary or permanent irrigation systems or connections shall be allowed. You can find the current restrictions here.

Certified Habitat Stewardship Program

1. What are the benefits of native habitat?: Native plants are well adapted to the local climate and soil conditions where they naturally occur. They provide nectar and pollen that serve as food for native butterflies and other pollinators as well as food and shelter for wildlife, helping to create a fully functioning and self-sustaining ecosystem. Native species require less maintenance, needing fewer fertilizers and pesticides than non-native varieties, reducing the amount of chemical runoff and contamination to surrounding soils and water sources. They also require less water for establishment and peak performance, as well as high deer resistance, both valuable attributes in our Texas climate. Increased use of native plants promotes local biodiversity and stewardship of our regionally specific, natural heritage.

2. What plants are acceptable?

There are numerous resources available to learn more about plants native to central Texas. Find several on our program website or on the City of Austin's website.

3. What plants tolerate shade?

Although shade plants may not bloom as profusely as their sun-loving counterparts, there are still many native plants that perform beautifully in semi to deep shade. Please see this link for a comprehensive list of shade-loving species from Wildflower.org.

4. What plants help Monarch butterflies?: Sadly, Monarch populations are in decline due to loss of habitat and associated food sources. Monarch larvae rely on species of the Milkweed genus, Asclepias. Please see the helpful links on the program website for more information on how you can do you part for Monarch conservation.

5. How do I create a pollinator garden?: The most important aspect of gardening for pollinators is providing plant diversity. Pollinators in general, butterflies, bees and birds, are attracted by different bloom colors, shapes and plant characteristics. For example, butterflies require both larval host plants as well as nectar sources to satisfy distinct needs throughout their life cycles. 6. How do I create a plan for my garden?

There are several key concepts to consider when planning or designing a new garden space. First, work with, and not against, the space that you have. Consider the natural landscape and topography. Consider sunny or shady areas and what plants might perform best in certain types of light. Consider color combinations, seasonal successions and height levels or layerings. 8. What about snakes and critters?

The overwhelming majority of snakes present in our home gardens are harmless, non-venomous and a valuable part of our native ecosystem. In fact, many snakes perform a valuable service keeping less desirable species of rodents and insects in check, providing efficient and natural pest control. However, some snakes can be hazardous or even deadly. Visit the Texas A & M University website for more information about local venomous snakes.

Some habitat elements, i.e. rock or brush piles, can attract unwanted animal inhabitants. Please research these design elements before including them in your garden plan.

The City has no obligation to entertain request to purchase City owned land. Nonetheless, if the City wishes to entertain a request to purchase land, it must follow procedures set out in the Texas Local Government Code governing sales of real property by municipalities. Upon receipt of your inquiry, the City will conduct an internal review to determine whether the property may be needed for future projects or whether the property is unneeded surplus property. If City staff determines that the property is suitable for disposition, it will seek authorization from the San Marcos City Council to advertise the property for sale to the highest bidder. The City Council reserves the right to accept the highest bid or reject all bids.

What do I do about a barking dog?: If you are unable to amicably resolve a barking dog situation with the dog's owner or caretaker, you may contact the City's Animal Services Department at 512-805-2650. The Court will provide you with additional information regarding whether you may be eligible for a dismissal of the citation upon returning any overdue books or library materials.

When you have returned your library books or library materials to the Library you will receive a compliance letter which you will need to submit to the prosecutor at the City Attorney's Office located at 630 East Hopkins Street. If all requirements have been met a dismissal will be prepared and forwarded to the Municipal Court. 9. Where do I file a citizen complaint?

Application for Citizen's Complaint for Class C misdemeanor violations may be obtained from and filed with the City Attorney's Office in person at the City Hall Building at 630 East Hopkins Street, San Marcos, Texas 78666.

The City's municipal court prosecutor will evaluate the complaint to determine whether the complaint alleges a violation over which the City's Municipal Court of Record has jurisdiction and whether the violation can be proven beyond a reasonable doubt. The municipal court prosecutor retains prosecutorial discretion as to whether or not to pursue prosecution of the case.

10. My vehicle was towed who do I contact?

The City does not have jurisdiction over most towing complaints. Only if there is an alleged violation of certain requirements of the City's wrecker ordinance under Chapter 90, Article 4 of the San Marcos City Code, would the City have jurisdiction to investigate or prosecute the violation.

8. Where in Hays County/San Marcos can I be tested?: Testing locations can be found here on the City’s website. The testing stations offer oral swab tests. Anyone is eligible to participate in the testing, with or without symptoms present. An appointment is required, no walk-ups are allowed. You will need an ID or insurance card to make an appointment. Appointments can be made by scanning the QR code on the attached flyer or visiting Curative’s website. The testing is provided at no cost to the individual and is available to anyone, whether or not they reside in Hays County. Curative is now billing private insurance companies for test services, but there will be no out-of-pocket cost to the individual being tested. Those without insurance will not be turned away and will receive the test for free.

10. Can someone with no health insurance get tested for COVID-19?: Yes, people with no health insurance have the option of getting tested at a public health lab or at a private lab. Testing locations can be found here on the City’s website.

11. When should I get tested?

You should call your health care provider or the local health department if you are experiencing fever above 100.4 along with cough, chest congestion, or shortness of breath. You will be asked a series of questions to determine whether you meet certain testing criteria before you can be tested.

Testing criteria includes having fever, cough, shortness of breath PLUS:

- have had close contact with a confirmed case,

- have traveled to a location with ongoing transmission of COVID-19,

- have risk factors for getting very sick from COVID-19, or

- being hospitalized with COVID-19 symptoms even if you do not have any risk factors.

12. Have any travel restrictions been placed at the San Marcos Municipal Airport?: No travel restrictions have been implemented at the airport. However, the travel restrictions in place nationwide do apply to people traveling to and from our airport. We will provide ongoing updates.

13. If my job is impacted by state or federally mandated closures, will my landlord be able to evict me if I can't pay my rent?

Evictions are civil matters between landlord and tenant and are presided over by our local Justices of the Peace.

On Tuesday, April 7, 2020, the San Marcos City Council passed an ordinance requiring a landlord to provide a Notice of Proposed Eviction prior to issuing an actual Notice to Vacate. The San Marcos ordinance gives tenants a 90-day period to cure any delinquency as a result of the COVID-19 pandemic.

1. What is a cycle track?: A cycle track is a separated bike lane or exclusive facility for bicyclists that is located within or directly adjacent to the roadway. One of the defining features of a cycle track is that it allows bicyclists to be physically separated from motor vehicle traffic with a vertical element, such as bollards. Cycle tracks are differentiated from standard and buffered bike lanes by the vertical element. They are differentiated from shared use paths (and sidewalks) by their more proximate relationship to the adjacent roadway and the fact that they are bike-only facilities.

3. Who can use the cycle track?: Bicycles, electric personal assistive mobility devices, and motor-assisted scooters meeting Texas Transportation Code Chapter 551.

4. Can two riders ride side-by-side (two abreast) in the same direction on the cycle track?: No, it is not safe to ride two or more abreast. Each bike lane within the cycle track is 5' wide, therefore, it is only safe to ride in single file in one direction.

5. Is there a speed limit?: The speed limit is 15 miles per hour.

6. Who has right of way at intersections?: Where vehicles, bicycles and pedestrians meet at intersections, vehicles give way to cyclists, who give way to pedestrians.

4. When my breaker fails, who is responsible for replacing it?: Customers are responsible for replacing their breakers and have the option to contact an electrician for assistance.

5. What is the most frequent cause of power outages in San Marcos?: Power outages are most frequently caused by weather events, animals, or vehicle collisions.

6. When my meter loop is damaged, what am I responsible for repairing?: If the service is overhead, then the customer is responsible for any part of the connection past the service line termination. 8. When will the City trim tree limbs?: In order for the City to provide reliable and safe electric service, tree limbs are trimmed ten feet away from any electrical line. 9. Who do I call if there is a low hanging wire or a wire on the ground?: Please avoid low hanging wires and call the Electric Utility Service Department at 512-393-8313 as soon as possible.

10. How do I request an underground line locate for utilities?: Customers must call the 811 hotline or 800-DIG-TESS (800-344-8377) at least two working days prior to beginning excavation. The hotline operator will notify local utilities of the dig location, and utility representatives will mark underground utilities with paint or flags. Private property utility lines will not be located by the representative. 811 hotline

11. When my meter loop is ready, how do I request a meter?: The City of San Marcos Permit Center must inspect the meter loop for correct installation. Upon inspection approval, the Permit Center will contact the Electric Utility Service Department. Customers must also establish an account with the City of San Marcos Utility Customer Service Department prior to having a meter installed. 1. Why do we need mosquito control programs?: Without control programs the mosquito population would flourish and cause potential health and comfort problems. From a health standpoint, mosquitoes are known carriers of encephalitis, malaria and the yellow fever and dengue viruses. Mosquito-borne diseases cause more than one million deaths each year around the world. Mosquito bites can also infect a pet with the deadly canine heartworm.

2. How can we best control mosquito breeding?: By identifying their breeding sites and preventing the larvae from maturing to adults. Preventing larval development into adult mosquitoes can be accomplished by eliminating breeding sites. Check for standing water around your home and neighborhood. Dump the water out or notify Environmental Health at 512-393-8440 for treatment in the case of larger bodies of water.

3. Is it necessary to spray for adult mosquitoes in populated areas?: Yes. An integrated program involves stopping mosquitoes in both the larval and adult stages. Mosquitoes can travel several miles, which can override local larval control efforts. This can then result in the need for adult mosquito control.

4. Are the insecticides being used for controlling mosquitoes dangerous?: No. Insecticides are the most rigorously tested of all chemicals. They meet stringent standards before they are registered for use by the Environmental Protection Agency. When properly used by trained professionals, insecticides do their job and biodegrade quickly.

5. Are there methods other than the use of insecticides for controlling mosquitoes?: Various control methods are constantly under review. One effective approach involves the use of mosquito fish, which can be stocked in mosquito breeding sites to feed upon the larvae. Incidentally, studies have shown that many homeowner methods such as bug zappers, bird and bat houses and citronella plants eliminate only a very small percentage of the mosquito population. In fact, many beneficial insects suffer the effects of these devices as well.

6. What are bed bugs?: Bed bugs are small, wingless insects that have not been known to transmit disease. Adult bed bugs have flat, oval shaped bodies. They are between 1 to 7 millimeters in length (about the size of an apple seed). The size of an adult bed bug varies, because their bodies become larger after a blood meal. After eating they change to a reddish color. Bed bugs are usually active at night and bite humans and animals while they are sleeping. They can live several months without feeding.

7. Where are bed bugs found?: Bed bugs can be found anywhere, such as houses, apartments, group living situations, hospitals, hotels/motels, and public transportation vehicles. These places have areas where people sleep or spend significant amounts of time. Their usual hiding places are in seams of mattresses, box springs, bed frames, and along and/or directly behind headboards. Once a bed bug population multiplies, they can be found: behind baseboards; in cracks and crevices in furniture, floors, or walls; under cluttered areas; and in electronic appliances. A bed bug infestation is apparent by noticing black or brown spots (which are their waste products) on surfaces. The eggs, egg shells, and exoskeletons of the bed bugs can be found in their hiding places as well.

8. How are bed bugs transported?: Because bed bugs can be found in homes and a variety of public places, they can easily be transported from place to place by people. They can hide in the seams of luggage and in the folds of clothing. They can also be transported in furniture.

9. Can bed bugs make you sick?: Bed bugs are not known to transmit disease, but many people have mild to severe allergic reactions to the bites. Bed bug bite marks usually appear on the face, neck, arms, hands, but can appear on other body parts. The marks are slightly swollen, red areas that can itch or be irritating.

10. How can I get rid of bed bugs?: It usually takes multiple visits by licensed pest control operator who has experience in elimination of bed bugs. Please seek the advice of a licensed pest control operator for treatment options. Over the counter foggers and pesticides will not eliminate bed bugs.

11. Is there effective treatment for bed bug bites?: If you are experiencing bed bug bites and feel that you are having an allergic reaction, please contact your physician. Topical antihistamine or anti-inflammatory medication may provide relief

Fixed food establishments must obtain a TFE permit when:

-Providing and serving food off site to the public. This does not include catered office luncheons, private parties, or weddings.

- When operating outside the normal bounds of the Fixed Food Establishment permit. e.g. a mixed drinks only bar hosting a food event on site for the weekend, or a Fixed Food Establishment preparing food/drinks outside a building and outside the bounds of the originally approved permit.

6. Are Mobile Food Units required to obtain a Temporary Food Establishment Permit to take part of an event?: No. A mobile unit currently permitted with the City of San Marcos is not required to apply for an additional temporary permit when participating in special events.

7. Is the TFER inspection report Quick Reference available for reference?: A helpful guide to navigating the TFER has been provided by TX DSHS. It is called the Regulatory Quick Reference. This can be used to quickly reference the TFER and further details the 1-47 violations.

8. Why do Mobile Food Units have to move each day and will this requirement change if parked in an established Food Truck Park?

TFER requires Mobile Food Units to report to their designated Central preparation facility daily. This requirement will not change if parked at a Food Truck park.

(b) Central preparation facility.
(1) Supplies, cleaning, and servicing operations. Mobile Food Units shall operate
from a central preparation facility or other fixed food establishment and shall report
to such location daily for supplies and for cleaning and servicing operations.

9. Is a Temporary Food Establishment Permit required for contestants participating in a judging contest? Can samples be given with or without a fee?

Participants in a food judging contest will require a Temporary Food Establishment permit if any foods are prepared and served to persons, other than judges of the contest, regardless if a fee is charged.

If a judging contest participant meets the above criteria for requiring a food permit all foods must be prepared on site with no storage or preparation of foods at a residence.

If a participant only provides samples of food to judges during the contest no Temporary Food Establishment permit will be required.

10. Why does a Food Handler have to be present at the booth where food is being prepared and not just available?: The responsibility of the Food Handler at a Temporary Food Establishment is to oversee the operation to minimize the potential of a health hazard and verify permit requirements are being met. A Food Handler is not able to oversee the food preparation and service if not actively present in the booth.

11. Are events associated with SMCISD exempt from obtaining a Temporary Food Establishment Permit and paying the associated fee?: No. Events associated with SMCISD events are still required to obtain a permit. If the association, club, booster, etc, are able to demonstrate a non-profit status or letter showing that they fall under the SMCISD governmental agency exemption, then the fee is waived. If not, the fee is $53.00.

12. What is HACCP and is every establishment required to submit a HACCP plan?

HACCP stands for hazard analysis critical control point, this is a food safety system generally utilized by food manufacturers and harvest facilities. HACCP requires detailed plans and records to be written and kept by the establishment to insure that food safety is achieved before distribution to the public. Retail food establishments will be required to submit a HACCP plan to the COSM Environmental Health Department if they utilize the following specialized processes:

-Smoking food as a method of food preservation rather than as a method of flavor enhancement;

-Curing food;

-Using food additives or adding components such as vinegar: to preserve/render non-time/temperature control for safety food;

-Packaging time/temperature control for safety food using Reduced Oxygen Packaging method except where the growth of Clostridium botulinum and Listeria Monocytogenes are controlled;

-Operating a molluscan shellfish life-support system display tank used to store and display shellfish that are offered for human consumption;

-Custom processing animals that are for personal use as food and not for sale or service in a food establishment;

-Preparing food by another method that is determined by the regulatory authority to require a variance; or

-Sprouting seeds (such as alfalfa or wheat grass) or beans in a retail food establishment.

13. How can an establishment submit a variance requesting a modification or waiver to one or more requirements of TFER?

Staff is currently working on a variance application that customers may fill out and return for consideration. The application will detail how to submit a request of your intentions with justification of why the request should be given and how the rules and public safety will still be met. TFER currently states:

§228.243. Variances.
(a) Modifications and waivers. The regulatory authority may grant a variance by modifying or waiving the requirements of these rules if in the opinion of the regulatory authority a health hazard or nuisance will not result from the variance. If a variance is granted, the regulatory authority shall retain the information specified in subsection (b) of this section in its records for the food establishment.
(b) Documentation of proposed variance and justification. Before a variance from a requirement of these rules is approved, the information that shall be provided by the person requesting the variance and retained in the regulatory authority's file on the food establishment includes:
(1) a statement of the proposed variance of the rule requirement citing relevant rule section numbers;
(2) an analysis of the rationale for how the potential public health hazards and nuisances addressed by the relevant rule sections will be alternatively addressed by the proposal; and
(3) a HACCP plan if required as specified in §228.244(c) of this title that includes the information specified in §228.244(b) of this title, as it is relevant to the variance requested.
(c) Conformance with approved procedures. If the regulatory authority grants a variance as specified in subsection (a) of this section, or a HACCP plan is otherwise required as specified in §228.244(c) of this title, the food establishment shall:
(1) comply with the HACCP plans and procedures that are submitted and approved as specified in §228.244(d) of this title as a basis for the modification or waiver; and
(2) maintain and provide to the regulatory authority, upon request, records specified in §228.244(d)(4) and (5) of this title that demonstrate that the following are routinely employed:
(A) procedures for monitoring critical control points;
(B) monitoring of the critical control points;
(C) verification of the effectiveness of an operation or process; and
(D) necessary corrective actions if there is failure at a critical control point.

Finance - Hotel Occupancy Tax (HOT)

1. Who is required to report and remit the Hotel Occupancy Tax?: The tax must be reported and remitted by any individual or entity owning, operating, managing, or controlling a hotel within the corporate limits of the City of San Marcos. The term “hotel” includes motels, tourist homes, lodging houses, boarding houses, inns, rooming houses, or other buildings where rooms are provided for consideration of two dollars or more per day.

2. When are reports and payments due?: Reports and payments are due on or before the 20th day of each month following the month in which the tax is collected (i.e. when the taxable event occurred). If the 20th falls on a weekend or holiday, taxes are due on the following business day.
Example: Tax reports and payments for collections in January 2014 are due to the City by February 20, 2014. A report must be filed even if no tax is due for the reporting period.

3. What happens if a report or payment is not submitted on time?: A 15% penalty will be applicable in addition to the amount of tax owed if the taxes and report are postmarked / paid after the due date. In addition, if payment in not received within 60 days of the due date then an additional charge of 1% per month will also be applied. All penalties and additional charges are due and should be included at time when the tax payment is sent.

*Please remember that if a report is not filled out completely and signed, it will be considered incomplete and returned to the owner. Penalties and other additional
charges will continue to accrue until the report is filled out completely and returned to the City of San Marcos.

5. Are there always firefighters at the fire station?: No. The fire company may receive an alert to report to a scene of an emergency incident. Fire stations are fully staffed 24 hours a day but they do operate in an active 9-1-1 system. When they get an emergency call, the staff will respond the emergency.

6. What kind of work schedule does a firefighter have?: A San Marcos Firefighter works one of three shifts that are designated as A-Shift, B-Shift, and C-Shift. They work 24 hours on/48 hours off.

7. What is a fire apparatus?: It is a vehicle designed to assist in firefighting and other rescue operations. The terms fire engine and fire truck represent different types of firefighting apparatus.

8. Why does a fire apparatus respond to auto accidents?: In many instances auto accidents require Firefighters to remove injured persons who are trapped. Firefighters also assess the scene for hazards, such as fuel leaks, disabled airbags, auto batteries that may need disconnecting, and blocking lanes of traffic on the Interstate to keep responders safe.

9. Why does a fire apparatus respond with an ambulance on medical calls?

Fire Engines assist ambulance crews on calls for several reasons. Certain types of medical calls require additional personnel. Heart attacks, strokes, and major accidents and many other medical calls require additional personnel for effective medical treatment.

10. Are all fire apparatus's staffed with medically trained personnel?: All San Marcos Fire Department personnel are trained and certified to a minimum level of Emergency Medical Technician.

11. Why do I see fire trucks at the grocery store or at other stores?: Firefighters work 24-hour shifts, which require grocery shopping for food to cook, and shopping at other stores for other items needed to stock the firehouse.

12. What is the difference between a fire engine and a fire truck?: A fire engine is designed to carry 500 gallons water and pump water from a hydrant. Generally 1500 gallons per minute.

A fire truck is designed to carry ladders, special rescue equipment, and other special fire fighting equipment along with an elevating ladder. San Marcos operates three fire engines. We also operate three quints. A quint is like a fire truck in that it carries an elevating ladder and all of the equipment of a fire truck, but also carries up to 500 gallons of water and can pump water from the hydrant like a fire engine. A quint can do the job of both. Quints are much more expensive than an engine or truck.

13. How many firefighters respond to an incident call?: The San Marcos Fire Department requires a minimum staffing of at least three firefighters on each piece of fire apparatus. San Marcos Fire Department maintains needed staffing levels 24 hours a day, seven days a week.

15. What is an ISO rating?

ISO (Insurance Services Office Rating) classifies communities from 1 (the best) to 10 (the worst) based on how well they score on the ISO Fire Suppression Rating Schedule, which grades such features as water distribution, fire department equipment and manpower and fire alarm facilities. ISO field representatives use the schedule when surveying a community's fire protection capability. The score that is determined from applying the Fire Suppression Rating Schedule is translated into a public protection classification.

We encourage residents to change the smoke alarm battery when they change their clocks for Daylight Saving time in the spring and fall each year. 4. Is it true that the police will not be called?: - If you leave your unharmed baby (60-days-old or younger) with a person who works at a hospital, fire station or with an EMT, the police will not be called.
- You will not be prosecuted for abandonment or neglect.

5. What happens to my baby?: - If you leave your baby at a fire station or with an Emergency Medical Technician (EMT) worker, they will give the baby immediate medical care and then transport the baby to the closest hospital.

- The hospital will take care of any additional medical needs that your baby may have.

- The Texas Department of Protective and Regulatory Services (TDPRS) will then take custody of your child.

- After the legal responsibilities are fulfilled by TDPRS, your baby will be placed with a caring family.

11. Is there one civil service test for all the cities in Central Texas?: To our knowledge, each city administers its own test. The San Marcos Fire Department does not participate in a group test with other cities.

13. Can I volunteer as a firefighter in the City of San Marcos?: No. The San Marcos Fire Department does not utilize volunteer firefighters. We have a fully paid fire department staff. Staff works 3 shifts (A-B-C) on a 24 on/48 off schedule.

What’s the City of San Marcos Code of Ordinances pertaining to fireworks?: “The sale, possession, storage, discharge, or offer for sale of fireworks” is declared a public nuisance according to Chapter 38 of the City of San Marcos Code of Ordinances Sec. 28.054. The owner, lessee or occupant of the property or structure where fireworks are being stored or used are deemed responsible for violations of the ordinance.

2. Are fireworks allowed in San Marcos?: It is illegal to sell, possess, store, discharge, or offer fireworks for sale within the city limits of San Marcos or within 5,000 feet of San Marcos city limits, including sparklers and noisemakers. There are no types of fireworks that can legally be used in San Marcos.

3. What is the penalty for using fireworks within San Marcos city limits, or within 5,000 feet of the city limits?: The ordinance carries fines for violations of up to $2,000.

4. I’ve noticed someone illegally popping fireworks in San Marcos city limits. Who do I call?: Illegal use of fireworks can be reported to the San Marcos Police Department non-emergency line at 512-753-2108. Do not call 911 to report illegal firework use unless there is a life-threatening emergency. This allows dispatchers to remain available to respond to other emergency calls.

5. Will there be a public firework display in San Marcos?: The City of San Marcos does not have an event with fireworks planned that corresponds with the New Year’s holiday.

6. Is there currently a burn ban in Hays County?: Hays County is not currently under a burn ban. This means that fireworks can be sold and used in unincorporated areas of Hays County, outside of San Marcos city limits.

7. I live outside of San Marcos city limits. If I plan to set off fireworks, what rules should I follow?: Fireworks cannot be lit near schools, including colleges or universities, churches, hospitals, licensed childcare centers, gas stations, or near where fireworks are sold. Fireworks cannot be ignited or discharged in or from a motor vehicle or thrown toward a motor vehicle.

8. I live outside of San Marcos city limits and plan to set off fireworks. What safety tips should I follow?: Always follow the instructions listed with the firework and avoid shooting fireworks near dry grass, brush, or other materials that can easily catch fire. Keep fireworks out of the hands of children and never aim a firework where they could land on a house or hit a person. Have a bucket of water, a garden hose, or another water source accessible in case of an emergency. Always pick up and soak firework debris in water prior to disposal.

Grease Traps (FOG Program)

1. What is FOG?: FOG is short for fats, oils and grease. FOG is found in foods such as meats, sauces, salad dressings, foods cooked in deep fat fryers, cookies, pastries, cheese, butter and many, many more. The FOG Program is a written agreement between the City and the Texas Commission on Environmental Quality (TCEQ) that went into effect on January 1, 2009. This program seeks to reduce the number of sewer system blockages and overflows caused by fats, oils and grease.

2. What is a grease trap? How does it work?: A grease trap is a small reservoir built into wastewater piping a short distance from the grease producing area (typically the kitchen area). It is designed for the purpose of removing fats, oils, and grease and preventing them from entering the sanitary sewer system.

3. Do I need a grease trap?: A grease trap is required if your establishment generates FOG as a result of food manufacturing, processing, preparation or food service. Establishment such as restaurants, food processors, hospitals, hotels/motels, nursing homes, prisons and any other facility preparing, serving or making any foodstuff available for consumption may be required by the City to have a grease trap. 4. What maintenance schedule is required for a grease trap?: Grease traps will be completely pumped out a minimum of every 90 days or more frequently when:
- 25% or more of the operational capacity contains FOG or sediment
- The discharge of FOG causes obstruction in the City's wastewater collection system
- The establishment has a history of non-compliance

5. What happens if I don't comply with the FOG program?: Any person who violates any provision of the FOG Ordinance will be subject to the following:
- 1st Violation: Written warning
- Subsequent fines for violations occurring within a 2-year period
-> 2nd Violation: $1,000 civil penalty
-> 3rd Violation: $1,500 civil penalty
-> 4th Violation: $2,000 civil penalty

If it is determined an establishment is responsible for a blockage of the City's sewer mains, the owner will owe a civil penalty for violations occurring within a 2-year period. The fines are as follows:
- $1,000 for the 1st violation
- $1,500 for the 2nd violation
- $2,000 for the 3rd violation

Green Waste Cart Service

1. Who decided that the City should start a green waste program and how was the decision made?: The City created a Municipal Solid Waste (MSW) Comprehensive Plan from 2010-2012. The plan focused on how to manage the City's trash for the next 20 years. One of two big issues that came out of discussions around the plan was a way to divert yard waste from the landfill. The curbside green waste cart was the option the City chose to explore. The City conducted a green waste cart pilot program from November 2013 to January 2015. City Council approved the implementation of curbside green waste carts city-wide in January 2015. The MSW Comprehensive Plan was also adopted into the San Marcos Comprehensive Plan - Vision San Marcos: A River Runs Through Us.

2. How much do the new carts cost residents?: The City’s garbage fee is a flat-rate fee for all solid waste and recycling programs, including the curbside cart service.

3. What can I put in the new carts?: All yard waste (leaves, grass clippings, weeds, branches up to 5” in diameter) and soiled paper products (to-go pizza boxes, cartons with gabled top, paper plates, paper towels, paper napkins, paper cups)

4. Isn’t it a compost cart? Why can’t I put food scraps in it?: It is not for compost. It is for green waste only. It can only be used for yard waste and soiled paper products. State regulations prohibit food scraps in carts that are not picked up weekly,

5. Can citizens opt out of the program? If so, will citizens get an adjustment on their bill?: If a resident doesn’t want the cart, it can be removed. The fee will not be adjusted. We have a flat-rate fee.

6. 7. Can citizens keep the 96 gallon garbage carts? Is there a fee?: Yes, citizens can keep the 96-gal trash cart. It will be $3.00 more per month.

8. When will unwanted carts be picked up?: The City and TDS are working to get all the carts picked up and all other issues resolved by the end of November.

9. What happens if I use the carts for the wrong items?: The City and Texas Disposal Systems (TDS) have reassessed the City’s new green waste cart program and how the recent flooding has impacted this and all waste services. After further discussions, any green waste cart that is continually contaminated will be removed from the residence.

Items accepted in the green waste carts include yard waste (leaves, grass clippings, weeds, branches up to 5” in diameter) and soiled paper products (to-go pizza boxes, cartons with gabled top, paper plates, paper towels, paper napkins, paper cups). Any other items that are placed in the cart could contaminate the cart and the recycling process.

If there is contamination in the green waste cart, TDS will not empty the cart. The resident must remove all contamination. Residents can put up to 2 extra 30-gallon trash bags by their trash cart, on their next regularly scheduled trash service day for free until November 30th. Any extra trash bags set out by the trash cart after November 30th will be charged the contracted rate of $9.03 per bag. The original November 24 deadline for Barbara, Conway, River Rd, Riverside and Riviera has been removed due to service schedule.

Starting the week of November 30, City staff will be auditing green waste carts before they are emptied to check for contamination. If there is contamination, the cart will be moved off the curb and a letter stating why the cart was not emptied and a flyer with the correct placement of material will be taped to the green waste cart.

Human Resources - City Employee Homebuyer Incentive Program

1. Who is eligible for the program?: Full-time City of San Marcos employees who have not owned a home in the city limits in the past 12 months. Only one application per household.

2. Which types of homes qualify for the program?: Single family homes (including townhomes, condos, duplexes and patio homes) inside the San Marcos city limits. The home must be used as the employee’s primary residence and the employees must obtain a homestead exemption for the home.

3. What type of assistance does the program offer?: Eligible employees may receive $5,000 in the form of a zero interest, 5-year, deferred forgivable loan paid directly to the title company handling the home closing.

4. How can the loan be used?: The loan can be used for down payments and closing costs associated with the home purchase.

5. How do I apply for the program?: Submit the completed form to the City of San Marcos Human Resources Department for eligibility verification. After Human Resources signs the form, it should be turned in to the Community Initiatives Office in the Development Services Department. Please include a copy of the Good Faith Estimate for the primary loan with your application. Anyone included as co-borrowers on the primary mortgage loan must also be included as co-applicants for the program.

6. At what point in my home-buying process should I apply for the program?: An application should be submitted when an eligible employee has found an eligible home and is working with a lender on a home loan. It is important to notify your lender as soon as possible that you have applied for this program.

7. Will I need to make monthly loan payments?: No loan payments are made as long as the employee remains eligible for the program. The City of San Marcos reduces the balance by 20% each year ($1,000) on the anniversary date of the loan closing provided the employee continues to meet eligibility requirements. At the end of the fifth year, the loan balance has been reduced to zero and a lien release will be filed by the City.

8. What happens after I apply for the program?: City staff reviews the application for completeness and eligibility. If approved, an approval letter is sent to the employee. Staff will work with the applicant, as well as their lender and the title company, to prepare loan documents and to have the City’s funds available at the loan closing.

9. What happens if I move out of the home during the 5-year affordability period?: If at any point an employee becomes ineligible for the program; the current loan balance is due to the City. Employees become ineligible if they are no longer a full-time employee of the City, or if the home ceases to be the employee’s primary residence.

5. Why do males need to be neutered?: Unneutered male goats emit a very foul odor and are not suitable in an urban setting.

6. How do you deal with excrement?: It makes excellent compost. In fact, goats provide a simple way of recycling vegetarian food scraps. The goats will eat any vegetable scraps.

Governor Greg Abbott has issued an executive order limiting certain businesses and services as part of the state’s efforts to contain the spread of COVID-19.

The order includes the following:

All bars and similar establishments that receive more than 51% of their gross receipts from the sale of alcoholic beverages are required to close at 12:00 PM Friday, June 26. These businesses may remain open for delivery and take-out, including for alcoholic beverages, as authorized by the Texas Alcoholic Beverage Commission.
Restaurants may remain open for dine-in service, but at a capacity not to exceed 50% of total listed indoor occupancy, beginning Monday, June 29, 2020.
Rafting and tubing businesses must close.
Outdoor gatherings of 100 or more people must be approved by local governments, with certain exceptions.

Further Protocols:

Reminders for those going out:

Do I still have to stay home?: Beginning May 1, Texans are allowed to leave home to provide or obtain essential services or reopened services (restaurants, retailers, theaters, malls); however, social gatherings and in-person contact with people who are not in the same household should still be minimized.

3. Should I still practice social distancing, good hygiene, and wear a mask in public?: Yes. COVID-19 is still a threat to public health, and it is up to us as individuals to practice good hygiene to reduce risk. Keep a six foot distance between yourself and others, wash your hands frequently, avoid touching your face, stay home if you are feeling sick, and wear a cloth mask when out in public.

4. Are there special guidelines for people over the age of 65?

Guidelines for people over the age of 65 are posted on pages 6 and 7 in Texans Helping Texans: The Governor’s Report to Open Texas. These guidelines include:

Minimize face-to-face contact with others. Avoid young children.
If someone is assisting you, you and your family members or caretaker should wear cloth face masks. Remember a family member or caretaker can give you the virus even if they don’t appear to have symptoms.
Try grocery or restaurant delivery, mail order prescriptions, and phone appointments with your doctor. Call 2-1-1 if you need help with essentials.
Reach out to friends, family, or neighbors who can deliver essential items.
If you must go out, wear a cloth face mask, and stay six feet away from others.
Wash your hands often and for at least 20 seconds, or use hand sanitizer with at least 60% alcohol.
Disinfect surfaces, buttons, handles, knobs, and other places touched often.
Do not share dishes, drinking glasses, cups, or eating utensils with others.

Check in regularly with neighbors, friends, and family by calling, texting, emailing, video chatting, or even writing letters.

5. How can I determine my business’ capacity?: To determine your occupancy limit, please contact the San Marcos FD Prevention Division at (512) 805-2600 or fireplan@sanmarcostx.gov, and an Inspector will respond to your location and calculate your allowed occupancy.

6. I am the owner of a restaurant or retail business reopening. What should I do to keep myself, employees and customers safe?

All employees should be trained on environmental cleaning and disinfection, hand hygiene, and respiratory etiquette.
Screen employees before coming into the business for new or worsening cough; shortness of breath; sore throat; loss of taste or smell; feeling feverish or a measured temperature greater than or equal to 100.0 degrees Fahrenheit; or known close contact with a person who is lab-confirmed to have COVID-19. Any employee who meets any of these criteria should be sent home.
Upon entering the business, employees wash or sanitize hands.
Maintain at least 6 feet separation from one another.

7. As a business owner, am I allowed to require customers to wear face coverings in my establishment?: Yes, individual businesses can require face coverings be worn by customers upon entry.

8. If I would like to dedicate certain periods of time each day for only at-risk customers, what are my options?: It is preferable to allocate 1 to 2 hours in the morning hours for at-risk customers. 4. What are the parking restrictions Downtown?: There are many on-street parking locations throughout Downtown. Most on-street parking has a 2-hour time limit from 8 am – 5 pm Monday through Friday. 1. Are there plans for a large scale spay/neuter program and where would they occur?: The City has some funds secured and working on a contract. A variety of resources would be utilized including private vets and mobile clinics.

2. Will any of the implementation plan changes affect how you do animal intake (at the shelter)?: The pros and cons of policies, procedures, and initiatives were assessed by the committee; also looking at creative solutions to managing intake.

3. Is the shelter allowed to close intake, being a municipal shelter?: We've had to close intake a few times recently due to overcrowding (from an additional 176 animals from the seizure case); owners wishing to surrender their animals were referred to other resources or asked to delay bringing their pet to the shelter.

4. Will there be a limit on the number of cats and dogs can have in the city of San Marcos?: The committee will look at this eventually, as a City of San Marcos Ordinance revision will occur upon completion of the implementation plan. City staff meets regularly with regional government partners to discuss the regional impact, contracts, and initiatives.

5. Has the increase in hours of availability at the shelter had an impact on adoptions? Will there be additional hours, days, or locations added in the future?: Extended hours only began in January, so it's too soon to show an impact. Plans are also in place to increase adoptions through off-site events. Budget requests are being considered to increase staff, which might allow for more days/hours open for adoptions. Events and locations outside of San Marcos require coordination with other government partners.

6. How will we know the progress of the government partners meetings in comparison to this process? Will that be available to the public so feedback can be provided on that as well?: The government partners receive updates from the implementation plan committee, but their meetings have mainly been to discuss operations and contracts. The request for the government partners meeting minutes has been noted.

7. Will the widespread spay and neuter efforts be done at the shelter?: The shelter does not have the space to provide services to non-shelter animals, but we are looking at a variety of alternatives including private veterinary offices and mobile services.

8. Is there currently a plan to increase the visibility of the shelter and its needs?: We have been doing more in regards to visibility and promotions and will continue to do so. Others in the audience confirmed the tremendous increase and impact.

9. What is the role of the community of vets, techs, pet groomers, and other industry professionals?: Committee members are already involved in the animal community and those perspectives should filter into the committee through them. Priorities identified so far by the committee include bolstering the involvement of those mentioned.

10. Can there be a Facebook page to help rescues pull animals to help them and help the shelter?: We are working on improving the rescue process and it is one of the new Program Coordinator's priorities. Budget requests are being considered to increase staff, which might allow for more staff time dedicated to the rescue program.

11. When does the survey close?: Some notice will be given prior to the survey closing, but it will be open through April.

13. Can you talk about the forecasting for the cost of the plan and how money will be raised?: Some needs and costs are already known just form the basic shelter operations standpoint. What is the timeline for funding and implementing the different components; and who implements?: Because current-year budgets will start in October, San Marcos and the regional partners will need to work quickly to fund any year 1 components. The success of the plan depends on collaboration among all partners, but the duty to implement fall on the shelter staff.

15. Why is the timeline 5 years?: The City of San Marcos has many needs and considerations; it will take time to allocate funding and dedicate staff time. Although 5 years is allowed, we will work as quickly as we can.

16. When will the foster and volunteer programs be enacted?: Those programs are under review and should be rolled out soon.

17. Is there a plan or timeline to have free spay/neuter clinics for TNR community and feral cats?: We have some funding available and are trying to get some clinics going soon.

18. What are the numbers of cat intake compared to those adopted out?: The statistics are on our website; please keep in mind that other cities in Hays County have different ordinances and the shelter only handles cats in San Marcos or cats brought to the shelter from other areas of the county.

19. Will there be specific communications/education regarding TNR/RTF (community and feral cats)?: Yes, and we are looking at initiatives that are easy to achieve; these initiatives have come up repeatedly through the committee's work and we anticipate they'll be included in the plan.

20. What is it about the Target Zero data/presentation that stands out?: Cats and large dogs. There may be additional factors, such as the large renter population in San Marcos and the low-income levels, that the committee needs to review to determine how we can best improve the live outcome rate for both cats and dogs.

21. What is the progress on getting a Facebook page to facilitate animal rescues?: It is being discussed and improving the rescue process is a priority.

22. Is it a viable option to have play groups and behaviorist to work with dogs?: That has come up during the committee's work and the prioritization is still to be determined. We are definitely interested in solutions for large dogs as identified by the data.

23. Will the low income levels in the area affect our ability to obtain funding?: We will work with our government partners to cost-share as well as with organizations such as Best Friends and Maddie's Fund to secure funding.

24. How will Veterinarians county-wide be involved in the efforts and initiatives?: We are simplifying our process and contract; we will make individual contacts and request collaboration.

25. Are you interested in becoming a Best Friends network partner to be eligible for free fundraising?: We are now connected to Best Friends and plan to explore that partnership further.

26. Does the shelter participate in the Amazon Smile program?: Unfortunately, because the shelter falls under a municipality and not a 501 (c)(3) non-profit, we are not eligible for fundraising programs such as that one.

27. How actively have the government partners engaged their own communities and promoted this?: All communications/information departments have been working together. For example, they're sharing Facebook posts originated in San Marcos. We are also relying on the general public to spread awareness through their own networks.

28. People are still afraid to take their animals to the San Marcos shelter for fear they're going to die; how can I help promote and share the good information and work that's been done?: We have achieved a consistent increase in the live outcome rate and we would appreciate assistance in sharing the good news to combat any negative perceptions.

29. What are the other Ideas, comments and feedback received through email or at a public meeting?

TNR and RTF programs are needed and will greatly impact the live outcome rate; include education
Use a behaviorist/trainer for cats too

31. Are animals spayed/neutered before being adopted from the shelter?: Yes; also, the implementation plan currently includes spay/neuter across the entire community.

32. Will there be an opportunity to speak at the June 18 work session or other city council meetings to provide input regarding the implementation plan?: Written comments can be submitted to the City Council at any time and people can sign up to speak at the regular City Council meetings. We are capturing all comments received at the public input meetings as well as through the email address pawsitiveoutcomes@sanmarcostx.gov and will make all available to the City Council.

33. Where are the sterilizations performed on shelter animals prior to leaving the shelter?: Shelter animals are spayed/neutered on-site at the shelter.

34. Is there a veterinarian on-site at the shelter?: A veterinarian is on-site for surgeries and is available as needed for other medical issues or concerns.

35. When spay/neuter services are offered to the general public, where will that service be provided?: Community spay/neuter will not be performed at the shelter; instead, we contract with various vets and other services such as Emancipet.

36. We need to educate the people about sterilizing their animals.: Yes, and that is a recurring theme in the implementation plan.

37. Has there been discussion about having a heartworm treatment program/fund so that all adoptable animals are at least starting treatment prior to being adopted or rescued?: We are working on a system to track donations specific to treatments, and we’re also working on a foster program to help those animals find the proper environment for the duration of treatment.

38. How many kennels do we have for adoptions vs intake?: We are in the process of adjusting the space for each to maximize the amount of space to make adoptable animals more visible. Restricted areas will be marked with a notice that entry past a certain point is limited to staff only due to the risk of exposure to dangerous and contagious animals.

39. Will there be a proposed budget to review prior to the June 18 work session?: We will do our best to cost out each year of the implementation plan for the City Council. However, budget requests for Fiscal Year 2020 (beginning October 1, 2019) were submitted earlier this year based on the estimated funds needed to bolster core services. Once that is done, we can focus on funding the implementation plan over the next 5 years. There is some overlap, so some of the initiatives in the implementation plan may have been included in the existing budget requests.

40. Have the other government partners (Hays Co, Kyle, Buda) been planning for the implementation as well?: We have been holding regular meetings with them as well and keeping them up to date on the progress of the committee. We recognize that the implementation plan has a better chance of success if all entities’ policies and initiatives are closely aligned.

41. What is the definition of “No-Kill” and what is included in the calculation of the live outcome rate?: It is defined by some animal welfare organizations but it’s not as clearly defined or differentiated for a municipal animal shelter with open intake (meaning we take animals hit by a vehicle with no chance of survival, or owners who request we euthanize their animals so they don’t suffer). The directive we have from San Marcos City Council is to come up with an implementation plan to reach a 90% live outcome rate. We want to make sure we can meet that number but also not lose sight of being humane in all things we do.

42. When you foster an animal, how do you know that it will be adopted out?: We rely on fosters to help us promote the animal and showcase their behavior in a home environment (as animals often display different/less favorable behavior in the shelter). Between fosters, rescues, and our own advertising, we hope each animal will get the exposure they need to get adopted.

43. Is there anything that can be done to improve the environment for the animals, using sounds or scents?: We are currently working on installing some sound baffles. We also had someone offer to help us play soothing music. We are starting a Task Force internal to the City to help move some of these projects along.

44. How long has the longest stay animal been at the shelter?: Meri just got adopted, after 165 days at the shelter.

45. Is there a maximum length of stay we will allow an animal to stay in the shelter?: It depends on each animal and their tolerance level. Different programs and breaks from the shelter can enhance quality of life. All of the components being implemented will hopefully make this a non-issue.

46. Is there a plan to expand the shelter and/or incorporate some play yards?: We do have some play areas now. The land adjacent to the shelter is City land but there are already other plans for it. We are anticipating the need for expanded and/or new space.

47. Do you have any plans to work with the college?: We do get volunteers from the college. One of the ideas we have for college students is to leave their pets at home and when they come to San Marcos, they can adopt an animal from the shelter and bring it back at the end of the semester or when the need arises.

48. Do you find that the $15 orientation fee prohibits people from volunteering?: We no longer charge a fee for volunteers.

Why were Neighborhood Districts created?: Neighborhood Districts were created to replace our current options for medium and high density residential or neighborhood commercial development in existing neighborhood areas. Regulations in Neighborhood Districts are tailored to focus on compatibility, scale, and use in a more detailed and refined way than in undeveloped areas or preferred growth areas on our Comprehensive Plan. Our current zoning districts need to be replaced because they were designed to accommodate each development type the same way regardless of the location. For example, our current multi-family zoning district (MF-24) has the same standards whether it is located on Old Ranch Road 12, IH 35 or Springtown Way. Our Comprehensive Plan says that each of those areas should be developed differently and we need to tailor zoning districts to be appropriate in each of these areas. 2. Where are the new neighborhood zoning districts located?

No properties in the City will be zoned Neighborhood Districts until a property owner or the neighborhood requests a re-zoning and completes a new, more rigorous rezoning process. For more information about how the zoning process has changed click here.

Property owner requested zoning changes to neighborhood districts are appropriate in the following types of locations:

The property is not currently zoned single family.
The property is zoned single family but is in an area surrounded by different types of uses and the request is compatible with the surrounding

City initiated rezoning to neighborhood districts may take place after the completion of neighborhood studies if desired by the affected community.

Notice is provided to all property owners within 400 feet,
A notice of application is available to any community member that requests it,

3. If I live in a single family home within a predominantly single family area what changes will I see with the adoption of Code SMTX?

Single family homes within predominantly single family areas will remain substantially unchanged with the exception of the two items identified below:

Accessory dwelling units are permitted when all of the following standards are met:
- The property owner lives on the lot;
- There is room on the lot to provide an additional parking space behind the main house; and
- The accessory unit does not exceed 1,000 square feet or half the size of the main house whichever is less.
Rental Registration is required for all single family dwellings or accessory dwellings that are not owner occupied

1. Am I required to get a plumbing permit to fix damage to my property from the weather?: In most cases the answer will be yes if you are having to use new piping and fittings etc. To apply for a permit, go to My Government Online.

2. Who can apply for the permit? Do I have to hire a City registered plumber to do the work?

The property owner or registered plumber may apply.

If the property is your homestead and you are completing the work with your own hands no registered plumber is required.

If the property is not your homestead OR you are not completing the work with your own hands, then a registered plumber is required.

3. My plumber has already completed the work, will I be in trouble?: The International Codes the City has adopted allow for emergency repairs. A permit just needs to be applied for within 24 hours of the work being completed.

4. What fees will I have to pay for the permit and inspection?: No fees will be charged for any plumbing repairs resulting from the 2021 Presidents Day Winter Storm Event until April 16, 2021.

5. Do I have to have an inspection done once the work is completed?: Yes. We are able to do all inspections next business day as long as they are requested prior to 4PM the business day prior.

9. Does the river go in a circle?: No, it connects with the Guadalupe River outside of Gonzales and then eventually flows into the Gulf of Mexico. Please pay attention to all river exit signs.

10. Should I wear a life jacket?: We highly recommend life jackets for both adults and children, as the San Marcos River is a moving body of water and therefore can become unpredictable.

11. How long is the float?: The float will last roughly an hour from City Park to Rio Vista Park depending on the flow rate, where you enter and exit the river, and the number of tubers in the water. Once you reach the falls at Rio Vista Park you should exit the river.

12. Should I be aware of wildlife?: Yes, the San Marcos River is home to many different species of fish, turtles and yes, even snakes. Always pay attention to your surroundings and do your best not to disturb the habitat.

13. Is alcohol allowed in the parks?: No, per city ordinance.

14. Is alcohol allowed on the river?: Yes, as long as you are actively floating the river. You can not be standing on the river bank with open containers.

15. Are cans allowed?: Yes, but please dispose of all waste in the mesh bags provided by your tube rental company or bring your own waste receptacle.

16. Are there cabins available for rent?: No.

17. Can I kayak or canoe the river?: Yes, you can rent from a local vendor or you may bring your own kayak or canoe and access the river from any river access point.

18. Can I fish on the river?: Yes, pole and line, including rod and reel, fishing is allowed. You must comply with state fishing regulations and have a valid Texas fishing license. Regulations can be viewed on the Texas Parks and Wildlife website. It is unlawful for any person to possess or shoot a speargun while in or upon city owned property without a program permit issued by the department, per city ordinance. The term "speargun" means any type of device used for propelling a spear, or any other type projectile through water as a means of shooting or taking fish.

1. When did the program launch?

Scooters were deployed in the city on Wednesday, Sept. 30.

Scooters have been available to ride starting on Texas State campus on Wednesday, Sept. 23, 2020.

Bikes were deployed fall of 2021.

2. How did the City pick SPIN?

In light of reduced capacity on buses due to COVID-19 social distancing restrictions and the end of a bike share service for the upcoming academic year, Texas State University began negotiations with Spin to deploy electric scooters as a means of augmenting available transportation options for students. Such a deployment on campus, however, would necessitate allowing the use of scooters on city streets as students travel to downtown businesses and other locations around the city. The City viewed this as an opportunity to conduct a pilot program with Spin to evaluate the impact of electric scooters through the end of the University’s Spring semester. The pilot program was used to assess infrastructure limitations and public safety concerns associated with the use of scooters in the city.

In partnership with Texas State University, a joint request for proposal was released to the public. September 2021 council approved SPIN as the full time provider of micromobility for the City of San Marcos.

3. Will scooters and bikes be deployed at TXST and in San Marcos?: Yes.

4. How much will it cost to ride a Spin scooter or bike?

Scooters and bikes will cost $1 to unlock and $0.29 + taxes per minute to ride. In order to complete a ride and avoid further charges, scooters should be parked in designated areas that are identifiable to riders through the Spin mobile app.

5. What do I do if I want to report an improperly parked scooter?: All the scooters have a sticker on them that includes a phone number and an email to which scooters can be reported. Improperly parked scooters can also be reported through the Spin mobile app. Spin Helpline and Email: support@spin.pm or call 1.888.262.5189.

6. How fast will the scooters go?: Spin scooters have a top speed of 15mph. In certain “slow ride zones”, the scooters will automatically slow down. In certain No Ride Zones, the scooter throttle will not engage at all.

7. Where are the No Ride Zones?: There are several No Ride Zones and Slow Ride Zones around the city. Scooters and bikes will not be allowed to be ridden to the river or along river trails. Most of the downtown San Marcos area will start out as Slow Ride Zone. Some additional No Ride and Slow Ride Zones are viewable in the Spin App – which is the best place to view up-to-date geofencing.

8. What will happen if I ride into a No Ride Zone?: If a rider enters a No Ride Zone (NRZ), the throttle will automatically disengage so there will be no more power going to the motor. The brakes will NOT be applied, but rather the scooter or bike will coast to a stop. The rider should then move the scooter back out of the NRZ and resume his or her ride. Anyone can identify No Ride Zones in the Spin App.

9. The City Council voted to ban commercial scooter companies from San Marcos, how is this program possible?: The ordinance provides for exceptions in its restrictions, including a motor-assisted scooter authorized under terms of a written license agreement with a company approved by city council. 1. What are TTHMs?: TTHM is an abbreviation for Total Trihalomethanes that form as a by-product during the water treatment process when chlorine reacts with naturally occurring organic matter. The longer the water remains in a pipe, the more of these by-products may be created. For more information please call 512-393-8010.

2. Why is chlorine used as a disinfectant?: Easily considered the most significant public health achievement of the 20th century, chlorine is used to remove waterborne diseases such as typhoid fever and cholera, so that drinking water is safe to consume. The Environmental Protection Agency (EPA) and the Texas Commission on Environmental Quality (TCEQ) require that Public Water Systems use some form of chlorine to disinfect drinking water. Because the risk of waterborne diseases and its effects are much greater than the risk posed by TTHMs, chlorine is still used to disinfect drinking water. 3. How are TTHMs harmful?: According to TCEQ, some people who drink water containing TTHMs in excess of the maximum contaminant level over many years may experience problems with their liver, kidneys, or central nervous system, and may have an increased risk of getting cancer. 4. What is the Maximum Contaminant Level for TTHMs?: Maximum Contaminant Level (MCL) is highest permissible level of a regulated contaminant. The MCL for TTHMs is 0.080 milligrams per liter (mg/L). This means that 1 mg/L is equivalent to 1 part per million (1 part per million would be equal to 1 penny out of $10,000). For more information please call 512-393-8010.

5. Is the water safe to drink?: Yes! At no time was the City’s water unsafe to drink. This is not a public health emergency. There is no need to seek an alternative water supply. You do not need to boil your water or take other precautions before consuming City Water. There are no known short term acute impacts who have consumed water that has exceeded the MCL. I am temporarily leaving; do I still need to pay my utility bill?: As long as the utility account is in your name and is receiving service you are responsible for payment to prevent additional late fees or disconnection for nonpayment. 7. Does the City issue an adjustment for leaks?: Our water leak packets are available online or in one of our two utility billing offices. Packets contains a listing of all required documentation and instructions.

8. What if I know I won't be able to pay my bill on time?: You can contact the Utility Customer Service Division to discuss a possible arrangement or payment extension. Please understand any arrangement or extension does not waive the 10% delinquent fee which applies if the payment is not made by the due date.

9. Do you offer any special billing programs?: Yes, we do offer Budget Billing. This program is a monthly set amount based on previous 12-month bill history. Failure to maintain a good payment history will result in removal from the program. Reconciles annually during the month of April at which time you will either need to pay the total variance due or determine what to do should you have a credit. 10. What do I need to connect my utilities?

A current photo ID, a completed connection form and be prepared to pay a deposit or present a qualifying letter of credit, from a like utility company, to waive the deposit.

1. Is there lead in the water?: No lead has been detected in samples taken on September 16 throughout the city.

Lead readings above EPA action levels of 15 parts per billion were found in 5 of 12 test samples in the vicinity of the Hays County Government Center earlier in September. For more information please call 512-393-8009.

2. Is the water safe to drink?: The water is in full compliance with state and federal regulations regarding lead in drinking water designed to ensure public health. Under these conditions customers can use water normally. For more information please call 512-393-8009.

3. What are EPA action levels?: EPA action levels are triggers for evaluation of system water treatment process and are not violations of state or federal regulations.

The action level for lead is 15 parts per billion. A part per billion is comparable to 1 penny in 10 million dollars. For more information please call 512-393-8009.

4. Does the City have a history of lead contamination in the water?: Past sampling data have shown no elevated lead levels in the City’s source water or values above action levels in home sampling sites. Water chemistry tests show that the water is non-corrosive and not prone to leaching lead from plumbing. For more information please call 512-393-8009.

5. What is the City doing about these readings?: The City began a water sampling program near the Hays County Government Center in response to water quality problems experienced in the building. Tests from samples taken September 4 showed lead readings in 3 of 6 samples above the EPA’s action levels.

The water system in the area was flushed on September 7, and a new round of samples was taken September 8. These showed 2 of 6 readings above action levels but at different locations from the initial tests. City water distribution personnel conducted 3rd and 4th rounds of sampling September 10. The City has asked TCEQ to conduct confirmation sampling through a 3rd-party contractor.

Additionally, the City has formed a water quality task force consisting of Alan Plummer Associates Inc. (APAI), the Guadalupe-Blanco River Authority and City staff to work on addressing the problem. The task force will determine the appropriate next steps regarding additional sampling, interpretation of the results, identification of causes, corrective actions necessary and will start the water treatment analysis as appropriate. 6. Where does lead contamination come from?: There are generally 2 sources of lead in a water system: The source water itself or lead leached from brass parts in plumbing fixtures in buildings (lead is a significant component of brass manufactured prior to January 2014). 7. How can I tell if I have lead in my home water?: Homeowners can hire certified testing labs to perform tests of water at their home. Find an approved laboratory near you (PDF).

8. What can I do to reduce lead from my home’s drinking water?: Some home water filters remove lead, as do some of the pitcher type filters (Brita, etc.) These devices are available at local stores. Please read information concerning these devices to ensure they are suitable for lead removal.

Flush Your System: Let the water run from the tap before drinking or cooking any time the water in a faucet has gone unused for more than 6 hours. The longer water resides in plumbing, the more lead it may contain. Flush the cold water faucet for about 15-30 seconds.

Use Only Cold Water for Cooking and Drinking: Hot water can dissolve more lead more quickly than cold water. If you need hot water, draw water from the cold tap and then heat it. For more information please call 512-393-8009.

1. Who actually decided what areas lost power, how long they would be out, and when this would happen?: During rolling outages, ERCOT decides how much power has to be reduced to make the supply and demand match. Demand for power was more than what was available which caused the need for the rolling outages. The Lower Colorado River Authority (LCRA) is the transmission provider for San Marcos Electric Utility (SMEU) and they controlled turning our nine substation transformers on and off. SMEU had no control over the location or lengths of these outages. LCRA based those decisions on what load reduction was needed and what number and length of power outages at each transformer would meet that need.

2. ¿Quién decidió cuales áreas perderían energía, cuanto tiempo estarían sin energía y cuando sucederían?: Durante las interrupciones continuas, ERCOT decide cuanta energía debe reducirse para que la oferta y la demanda coincidan. Why did some areas seem to have power on more often than others?: All available feeders on the SMEU system were included in rotating service interruptions, but some feeders serve critical infrastructure including safety and health operations. These critical feeders did participate in the rolling outages but they were off less often. Some residential and commercial customers near critical facilities may be included on critical service feeders and therefore may have power more often than residential and commercial customers in other areas.

Why was my power off after the rolling outages stopped?: During and after the rolling outages, ice accumulated across the City which caused downed lines and broken insulators on poles, resulting in localized outages separate from outages mandated by ERCOT. There were also broken tree limbs and downed trees which had to be cleared. As crews worked to restore power, customers’ lights, heaters, and water heaters were all coming on at the same time causing fuses to overload. SMEU had to replace these fuses on all circuits, in some cases more than once. SMEU crews were addressing known problems during the rolling outages to avoid prolonged service interruptions, but some problems were not known until after the rolling outages stopped and customers reported they were still without power.

11. What will my electric bill look like because of this event?: Just like every month, customers will only be charged for the actual Kilowatts of power used at their address. Due to extremely cold weather, bills may be higher this month because of additional energy consumption required to heat your home or business. Even with the electric outage periods, reheating a structure from low temperatures can cause systems to run continually which results in higher energy usage. Also, homes with heat pumps likely had to use auxiliary heating elements as the outside temperatures got really low and this will cause the heat pump to use more power.

During this winter event, if it was 12 degrees outside and you wanted it to be 72 degrees indoors, your heating system was working harder than it had in the summer months to overcome that 60-degree difference.

15. When I look at the usage charts on my Customer Connect account screen they show small power amounts during periods when I had no power. How can that be right?: SMEU’s system retrieves information from your meter at regular intervals, and those daily readings can be seen in Customer Connect under the My Usage tab. During a power interruption, meter readings may not be available. When power is restored and the system retrieves new data from the meters, it prorates the consumption over the hours between two readings. This can lead to usage being shown in Customer Connect at times when no power was consumed. However, the billing system registers only the total actual Kilowatt hours used at your meter at the end of your billing cycle and this is what you will be billed for on your home or business account.

16.
